California state legislative special elections, 2013
Eight special elections were scheduled for the California State Legislature in 2013. These elections were called to fill vacancies in California State Senate Districts 4, 16, 26, 32, and 40, and California State Assembly Districts 45, 52, 54 and 80.
How vacancies are filled
If there is a vacancy in the California State Legislature, the governor must call for a special election. The governor must call the election within 14 calendar days of the vacancy. No special election shall be held if the vacancy occurs after the nominating deadline has passed in the final year of the term of office.[1]

January 8, 2013

Doug LaMalfa (R) announced on August 31, 2012 that he would resign his District 4 seat in the California State Senate after the legislature concluded its 2012 session. LaMalfa, who ran for U.S. House of Representatives, decided to resign early so that a special primary could be consolidated with the 2012 general election. On September 5, 2012, Gov. Jerry Brown (D) announced the special election would take place January 8, 2013, with the primary on November 6, 2012.[2][3] Jim Nielsen (R) initially looked to have won the blanket primary outright, but final returns showed him just short of the 50 percent plus one necessary to avoid a general election.[4][5] Nielsen easily won the special election.[6]

Gloria Negrete McLeod (D) was elected to the 35th Congressional District of California on November 6, 2012. A special election to fill the vacancy has been scheduled for March 12, 2013. Because no candidate received 50 percent of the vote the top two vote-getters - Norma Torres (D) and Paul Leon (R) - met in a runoff election on May 14.[9][10][11][12]

Juan Vargas (D) was elected to the 51st Congressional District of California on November 6, 2012. A special election to fill the vacancy took place on March 12, 2013, which Ben Hueso (D) won with 52 percent of the vote.[9][14][15][16]

Michael J. Rubio (D) resigned his seat on February 22, 2013, to take a job with Chevron. A special election was called for May 21, 2013. While Andy Vidak appeared to be the outright winner in the initial vote tally, after absentee ballots were counted he fell below the 50 percent threshold. A runoff election between the top two vote-getters - Leticia Perez and Andy Vidak - took place on July 23. Although the district boundaries changed due to redistricting, because Rubio resigned midway through his term, the old boundaries were used.[22] Candidates had until March 29 to file nomination papers.[23][24]

Ben Hueso (D) won election to the California State Senate on March 12, 2013. A special election was called for May 21, 2013, with a runoff election scheduled for July 30 if necessary. Lorena Gonzalez won the May 21 special election.[25] Candidates had until March 29 to file nomination papers.[26][27]

Candidates had until May 31 to file certified nomination papers with the Secretary of State. Since no candidate received more than fifty percent of the vote a runoff between the top two vote-getters - Freddie Rodriguez (D) and Paul Leon (I) - took place on September 24.[33][34][35]

Rep. Holly Mitchell (D) was elected to the California State Senate on September 17. A special election was called for December 3, with a runoff on February 4, 2014, if necessary. Candidates had until October 11 to file certified nomination papers with the Secretary of State.[49][50][51]
