Campaign Funding Lawsuit Dismissed

March 31st, 2012
Arizona: Judge Mark Brain of the Maricopa County Superior Court has dismissed the 2011 lawsuit that was filed by the Goldwater Institute against the Citizens Clean Elections Commission.[1]
The lawsuit accused Citizens Clean Elections Commission of illegally spending public money to promote Arizona's public campaign finance system. The commission is allowed by state law to spend money in order to educate voters about the public campaign funding system, but the commission is not allowed to spend money for self-promotion, wherein lied the lawsuit's allegations.[1]
Judge Brain's ruling stated that the commission does acknowledge that it is not allowed to take sides when regarding a possible ballot measure that may eliminate public campaign funding. However, as permitted by the First Amendment, the commission's other activities are perfectly legal in its authority to encourage participation by citizens in the electoral process.[1]
