An effort to recall four city council members and City Attorney Clinton Byers did not go to a vote in San Diego, California, after the California Supreme Court ruled that the recall effort was invalid in Muehleisen v. Forward because recall organizers had not complied with statutory requirements.[1][2]

The recall effort was organized by the City Charter League.[2]

Path to the ballot

Signed petitions were delivered to the city clerk on June 30, 1934. The clerk declared the signatures to be insufficient. Recall organizers filed additional signatures on July 23, 1934, and the clerk declared them to be sufficient. The city council refused to schedule a recall election on the grounds that the recall effort did not comply with the law. Recall organizers sought a writ of mandate to compel the city council to schedule an election, which resulted in Muehleisen v. Forward.[1]
