Recall reports

An effort in Otis, Colorado, to recall town council members Jesse Stackhouse, Sue Stackhouse, Lana Rogers, and Linda Bethel from their positions was initiated in December 2016. Former town council member Leon Payne initiated the recall effort.[1] The town council scheduled a special election during a meeting on February 21, 2017.[2] All four council members were recalled in the election on April 4, 2017.

The ousted council members filed a request with the mayor to invalidate the results on the evening of the election. This request argued that the town's notice of recall included an inaccurate publishing date and legal language regarding open meeting violations reserved for a court decision.[3]

According to state law, the number of valid signatures required to force a recall election is 25 percent of the votes cast in the last election for the official being recalled. A recall petition must be filed with the office in which nomination petitions are filed for the official that is being recalled. The petition must include a statement of no less than 200 words explaining the grounds on which the official is to be recalled. If the petition has been deemed sufficient, the official against whom the recall was filed may resign within five days without having the recall election held against them. If the official does not resign, a recall election is scheduled between 30 days and 60 days after the completed petition has been certified.
