An attempt to recall Dundy County Sheriff Clinton Smith in Nebraska was initiated in 2023. Former county commissioner Jerry Fries filed a petition to recall Smith on July 14, 2023. Recall supporters needed to gather at least 253 valid signatures for the recall to make it to the ballot.[1] A recall election was scheduled for November 14, 2023, and voters successfully recalled Smith from office.[2]

Recall supporters

The petition to recall Smith was submitted after the publication of a letter from the Commission on Law Enforcement and Criminal Justice indicating that Smith had been denied entry to the basic law enforcement certification program "because of misrepresentations in work history, criminal and traffic history."[1]

Recall opponents

Smith responded to the recall attempt by stating that he did have law enforcement experience by virtue of working for the Logan County Sheriff's Office in Colorado. Smith noted that the traffic history mentioned in the letter was a seatbelt infraction that he forgot to resolve before moving out of Oklahoma.[1]

No specific grounds are required for recall in Nebraska.[3] The number of signatures required to put the recall on the ballot depends on the office type. A majority of offices require signatures equal to 35% of the total vote cast for that office in the last general election.[4] Petition signatures must be filed within 30 days of the filing clerk issuing the petitions.[5]
