Judicial selection process

The seven justices of the Illinois Supreme Court and the 54 judges of the Illinois Appellate Court are selected in an identical manner. Judges are chosen by popular vote in partisan elections and serve 10-year terms, after which they must compete in uncontested, nonpartisan retention elections to remain on the court.[1][2]

The Illinois Circuit Court is the unified trial court in the state, divided into 25 judicial circuits. Circuit judges are elected in partisan elections to six-year terms. Upon the completion of these terms, judges who wish to remain on the court must compete in uncontested, nonpartisan retention elections.[1][3]

Judicial selection

Judges who sit on the federal district courts are nominated by the president of the United States and confirmed by the United States Senate. These judges serve life terms. To read more about the judges on these courts, click here.

There are three federal bankruptcy courts in Illinois. These courts have subject-matter jurisdiction over bankruptcy cases. The federal bankruptcy courts in Illinois are:

State supreme court

See also: Illinois Supreme Court

Founded in 1818, the Illinois Supreme Court is the state's highest court and has seven judgeships. The current chief of the court is Mary Jane Theis.

As of December 2022, five judges on the court were Democrats and two judges were Republicans.

The court meets in the Illinois Supreme Court Building in Springfield, Illinois on the second Monday in September, November, January, March, and May.[4]

In Illinois, state supreme court justices are elected in partisan elections. There are eight states that use this selection method. To read more about the partisan election of judges, click here.

The court has limited original jurisdiction, hears appeals of right in cases where the constitutionality of laws has been called into question, and has a docket of discretionary appeal from the Illinois Appellate Court. Along with the state legislature, the court sets rules for the state judiciary. The court has general administrative and supervisory authority over all courts in the state. This authority is exercised by the chief justice with the assistance of the Administrative Director and staff appointed by the supreme court. The supreme court hears appeals from lower courts and may exercise original jurisdiction in cases relating to revenue, mandamus, prohibition or habeas corpus. Its members also have the authority to appoint trial judges to the appellate court on a temporary basis.[5]

The table below lists the current judges of the Illinois Supreme Court and the appointing governor.

The Illinois Appellate Court is the intermediate appellate court in the state. There are five appellate districts and judges are elected to 10-year terms. The court hears appeals from the circuit courts, except for cases explicitly appealed to the state supreme court. The appellate court's rulings can be appealed to the Illinois Supreme Court.[1][6][7]

Trial courts

See also: Illinois Circuit Court

The circuit courts are the unified trial court system in Illinois and hold original jurisdiction. The circuit courts are divided into 25 judicial districts. Seven are single-county circuits and the remaining 18 circuits are multi-county districts. The court shares jurisdiction with the state supreme court to hear cases about habeas corpus, mandamus, prohibition, and revenue. The circuit courts also conduct reviews of certain state agency administrative orders.[3][8][9]

Circuit judges are elected to a six-year term and may run for retention for additional six-year terms. Judges are originally elected from within their judicial circuit, from their county of residence, or from a sub-circuit within the judicial circuit, depending on the relevant court vacancy. Associate judges are appointed by circuit judges in the relevant circuit. Circuit judges elect one of their members to serve as the chief judge of the court. Chief judges have general administrative authority in the judicial circuit and can assign cases to general or specialized divisions in the circuit. The chief judge is subject to the administrative authority of the Illinois Supreme Court.[8]
