Misconduct charges
In January 2011, Judge Ballou was charged with two counts of ethics violations by the Judicial Conduct Commission in Kentucky. He was accused of contributing to the political campaign of presidential candidate John McCain, and sending email to his fellow judges about Sen. Rand Paul's position on the 2nd Amendment. These acts were allegedly prohibited under the judicial canon stating that a judge "shall refrain from inappropriate political activity." Ballou denied the allegations on the grounds that he had the right to express his opinion under the 1st Amendment.[6][7] He was publicly reprimanded for the email about Paul, but the charges related to McCain were dismissed.[8]
