Illinois Supreme Court reverses decision to clear former nightclub owners

February 17, 2003, was anything but a party for patrons of Illinois nightclub E2.

In the infamous tragedy at a Chicago nightclub, 21 people died and more than 50 were injured after security guards used pepper spray to break up a fight, provoking a vicious stampede when 1,500 clubgoers scrambled for the inward-swinging doors. Owners Dwain Kyles and Calvin Hollins had been previously ordered to close the second floor of the club— the site of the stampede— after their chronic failures to keep the facility up to code. However, they later claimed the court order was confusing because it had referred only to a raised mezzanine area inside the club.[2]

Over the course of nearly a decade of controversy, owners Kyles and Hollins were given two-year prison sentences by Cook County Associate Judge Daniel Gillespie, but their sentences were later reversed due to the allegedly unclear order. However, in April 2013, the Illinois Supreme Court unanimously reversed the decision to clear them of indirect criminal contempt.[3][4] Justice Lloyd Karmeier wrote in a summary of the ruling,

Even if the orders could be viewed as forbidding only use of the mezzanine, the defendants had not complied even with this requirement.[4][5]

The case was sent back to the Illinois Appellate Court for reconsideration.[4] In November 2013, the appellate court ordered the two men to be re-sentenced by the trial court.[6]
