David N. Mortensen is a judge of the Utah Court of Appeals. He assumed office on July 14, 2016. His current term ends on January 3, 2027.
Mortensen ran for re-election for judge of the Utah Court of Appeals. He won in the retention election on November 3, 2020.
Mortensen was appointed to the position in June 2016 by Gov. Gary R. Herbert (R) for a term that expired on January 3, 2021. In order to remain on the bench, Mortensen stood for retention in the 2020 general election.
He previously served as a judge on the Utah Fourth Judicial District for Utah County.[1] Mortensen was appointed to that court in September 2006 by Gov. Jon Huntsman (R).[2] He was retained by voters in 2010 for a term that would have expired in 2016.[3]
Education
Mortensen received his J.D. from the J. Reuben Clark Law School at Brigham Young University in 1993.[2]

Court of Appeals nomination
2016
Mortensen was selected by Gov. Herbert to fill one of two vacancies on the Utah Court of Appeals. Upon announcing the nomination, Gov. Herbert said, “For the past 10 years, Judge Mortensen has been an example of what a judge should be, dedicated to the rule of law, hardworking and fair to all parties."[5]
2009
Mortensen was one of seven candidates selected by the Utah Court of Appeals Nominating Commission to fill a vacancy on the Utah Court of Appeals. Ultimately, he was not selected by the governor.[6]
