Defendant collapses as judge hands down sentence

FARGO, North Dakota: On Monday, January 9, 2012, Judge Steven E. McCullough of the East Central Judicial District handed down a three year prison sentence for the 74-year-old West Fargo man, Alois Vetter. Upon his sentencing Vetter collapsed and needed help to stand again.
He was found guilty of running over a former tenant with a hummer sport utility vehicle. He was convicted of aggravated assault with a dangerous weapon and reckless endangerment.[1]
The defense argued that the running over of the former tenant was unintentional and that the tenant was to blame for being in the street. They also argued that the hummer did not constitute as a dangerous weapon under North Dakota law. Assistant State’s Attorney Cherie Clark responded by saying, “Walking out into the street is not strong provocation, the defendant injected himself into this activity.”[1]
The case will be appealed and heard by the North Dakota Supreme Court in the next six to eighteen months.[1]
