Delaware Supreme Court sends back appeal

Delaware: An appeal, seeking to reinstate the death penalty against a man, was sent back by the Delaware Supreme Court without making a ruling.[1]

Jermaine Wright is believed to be responsible in the shooting death of 66-year-old Phillip Seifert, a liquor store clerk in 1991.[1]

Superior Court Judge John A. Parkins, Jr. had originally tossed out Jermaine Wright's conviction ruling in January of 2012 due to Wright not being properly read his rights at the time of his arrest, for Wright being apparently high when he gave his confession to shooting Phillip Seifert, and ruling that prosecutors may have improperly withheld from the defense important evidence.[1]

Judge Parkins, Jr. has been directed by the Delaware Supreme Court to investigate the claims of the possible withheld evidence from Wright's attorneys by prosecutors. With the case being sent back, it is indicated that the Delaware Supreme Court justices may consider to overturn Judge Parkins, Jr. ruling on Wright's confession by advising attorneys to believe the confession is legitimate and putting more focus on the possibility that prosecutors may have failed to turn over important evidence.[1]

As there is no physical evidence that places Jermaine Wright at the scene of the crime, barring only his videotaped confession, he may walk free if Judge Parkins, Jr.'s ruling is upheld.[1]
