District judge to rule on constitutionality of education reform laws

BOISE, Idaho: District court judge Timothy Hansen will decide a case challenging the constitutionality of a recent education reform law. The case against Governor Butch Otter and State Superintendent of Public Instruction Tom Luna was brought forward by the Idaho Education Association.[1] The IEA argues that Senate Bill 1108, which passed earlier this year, is unconstitutional because it violates both the single-subject rule and contract rights. The "Students Come First" law ended most collective bargaining for public school teachers, effective in June 2011. The law will also begin to phase out tenure and limit labor contract agreements to a one-year term.[2] Judge Hansen says he will issue a ruling within 30 days. Regardless of the case's outcome, a referendum on the law is slated for the 2012 Idaho ballot.
