'Rescinded' is not a final OIRA outcome.
OIRA has 90 days (with a possible 30-day extension) to complete its review of significant regulatory action. A rule cannot be published in the Federal Register prior to taking effect until the review is completed or the review period expires. OIRA review may result in one of the following outcomes:
- Consistent without change: OIRA approves of the rule and no changes were made.
- Consistent with change: OIRA approves the intent of the rule, but makes changes to the content, such as changes to avoid inconsistent, incompatible, or duplicative policies across agencies. This is the most common outcome of an OIRA review.
- Returned: OIRA finds fault with the substance of the rule during the review and returns it to the agency for further consideration. A returned rule is accompanied by a letter from OIRA that details the issues requiring resolution and offers suggestions for improvement.
- Withdrawn: The agency promulgating the rule withdraws it from review. The agency may revise and resubmit the rule or abandon it altogether.
