In June of 2005, Judge Rushing was arrested and convicted of driving under the influence. Rushing "was sentenced to 10 days in the Sonoma County Jail and three years informal probation after her attorney entered a no contest plea on her behalf. ... Another DUI charge and a hit-and-run charge, also misdemeanors were dismissed." Instead of serving jail time, Rushing took part in a work-release program.[2]
A year before her arrest, Rushing worked on two high-profile drunk driving cases involving the deaths of two bicyclists and the critical injury of another. Rushing handed down the stiffest possible sentence to the offending motorists.[3]
