This article identifies the statutory source of election law in Idaho and compiles information on proposed and enacted legislation that would modify election law in Idaho.

2024

In Idaho, legislators passed 14 election-related bills in 2024, including bills that changed absentee ballot collection rules and filing requirements for independent candidates for U.S. president and vice president.

  • HB 599 defines who may collect and return another voter’s absentee ballot. The new law permits a voter's family member, roommate, caregiver, or someone paid directly by the voter to collect and return their ballot. Other than an individual paid directly by a voter to collect and return their ballot, no other individual authorized under the new law to do so may collect or return more than six ballots. The law explicitly prohibits candidates or political party employees or volunteers from collecting and returning a voter’s ballot and provides for misdemeanor and felony penalties for violations. Previously, Idaho did not specify who could collect and return another voter’s ballot.
  • HB 661 sets a deadline of August 1, instead of March 15, for independent candidates for U.S. president and vice president to file a declaration of candidacy.
