Election law encompasses a wide array of issues, including voter registration, ballot access, early voting, absentee/mail-in voting and voter identification requirements. The laws governing the administration of elections can vary significantly from state to state and even between jurisdictions within states. This article identifies the statutory source of election law in Kentucky and compiles information on proposed and enacted legislation that would modify election law in Kentucky.
Analysis
2024
In 2024, Kentucky legislators passed nine election-related laws. Three of those were enacted as a result of the Republican-controlled legislative chambers overriding Governor Andy Beshear's (D) vetoes. These laws included provisions that changed how U.S. Senate seat vacancies are filled, banned ranked-choice voting (RCV), expanded requirements related to voter list maintenance, and changed local election policy. Another bill that was passed was a legislatively referred constitutional amendment regarding noncitizen voting. It was then submitted to voters for ratification or rejection.
- HB 622 requires the state to use special elections rather than gubernatorial appointment in the case of a vacancy for a U.S. Senate seat.
- HB 44 makes the state the sixth to prohibit RCV. It also requires the secretary of state to issue an annual and publicly available report detailing voter registration cleanup activities and requires the creation of new voter list maintenance resources, including a database consisting of each address in the state and the number of registered voters at that address.
- HB 388 changes the required number of petition signatures for the incorporation of a city and makes the election of several local offices, including mayor and city council, nonpartisan in a consolidated local government.
- SB 143 revises Sections 145 and 155 of the Kentucky Constitution to prevent noncitizens of the United States from voting in Kentucky. Voters approved the amendment in the 2024 fall general election.
