Eric L. DuTemple was the presiding judge for the Superior Court of Tuolumne County in California.[1] DuTemple was also a member of the Executive Committee of Trial Court Presiding Judges Advisory Committee. He retired on December 31, 2012.[2]

DuTemple was re-elected to a six-year term in 2010.[1]

Noteworthy cases

Whisky Fire

December 2009 - DuTemple convicted arsonist George Landecho Lopez to a maximum of 8 years in prison with no probation. In July 2009 Lopez escaped from prison and set fire to the legendary home, which previously housed film stars and served as a movie location. After originally pleading not guilty, the defendant arranged for a plea bargain, assuring him a maximum 8 years in prison and reduced counts of criminal behavior for a guilty plea. Right before sentencing, Lopez again switched his plea to not guilty.[3]

People v. Mower

March 2000 - This case helped define parameters of Proposition 215, or the Compassionate Use Act of 1996. Myron Mower was convicted of a felony for cultivation of marijuana and a misdemeanor for possession of more than one ounce of marijuana. Among five other contentions, the defendant charged that he was allowed complete immunity under the act due to his diabetes. The Court of Appeal Fifth Appellate District upheld DuTemple's judgment on all six counts in December 2000. [4]
