Mitchell, ex-wife Merrin Guice Gill respond to report of alleged 2007 assault (2023)

On January 3, 2023, the Milwaukee Journal Sentinel's Daniel Bice wrote that Mitchell "was accused by his ex-wife of sexually assaulting her [in 2007] — though the accusation was never investigated or prosecuted." According to Bice, Mitchell's ex-wife, Merrin Guice Gill, told a therapist and police officer about the alleged assault in the two weeks after she said it occurred. During a 2010 custody dispute, Guice Gill accused Mitchell of emotional and physical abuse and included the therapist's notes and police report from 2007 in a fax to the judge.[4]

According to Bice, Mitchell "vigorously denied that he has abused his ex-wife" and "noted he was not charged criminally and that the Dane County family court judge handling their custody dispute sided with him, giving him primary placement of the child."[4]

Mitchell and Guice Gill released the following joint statement on January 3, 2023:[5]

We understand that given Everett’s candidacy for Wisconsin Supreme Court, there is renewed interest in our divorce from two decades ago. We continue to prioritize the best interest of our child who is still a minor. We also are both proud of who we are both as co-parents and individuals and we know both of us did the best we could to carry ourselves with integrity during this difficult period in our marriage. We ask that the media and the other campaigns avoid engaging in unfair and misleading attacks. We ask that everyone prioritize the privacy and well-being of our child.[6]
