MEASURE C: Maintaining Quality Fairfax Services. Shall the Town of Fairfax extend the existing one-half percent local sales tax and increase the rate by one-quarter percent to provide funding that cannot be taken by the State, and can be used for a period of 10 years subject to annual independent audits to maintain and enhance quality public safety and general services, improve infrastructure such as repairing sidewalks, pedestrian trails, repaving streets, and enhancing downtown, while retaining Fairfax’s character?[2] |

The following impartial analysis of the measure was prepared by the office of the Fairfax Town Attorney:

In 2011, the voters of the Town of Fairfax approved the establishment of a retail transactions and use (sales) tax on the sale and use of goods within the Town (“TUT”), at a rate of one-half percent (1/2%). The TUT took effect in April 2012 and generates approximately $440,000 annually. The TUT is collected in addition to, at the same time and in the same manner as existing sales taxes. The TUT is a “general tax,” meaning that revenues raised from it go into the Town’s general fund and pay for general Town services, such as police and public safety, street and sidewalk maintenance and infrastructure improvements. The TUT is scheduled to expire on March 31, 2017. On July 13, 2016, pursuant to California Revenue and Taxation Code section 7285.9, the Town Council unanimously placed Measure “C” on the November 8, 2016 ballot. If approved by a majority of Fairfax voters, Measure C would continue and extend the current TUT for another ten (10) years and increase the rate, starting on April 1, 2017, from one-half percent (1/2%) to three-quarter percent (3/4%). It is estimated that this rate increase will provide an additional $225,000 in funding annually. The TUT would remain a “general tax,” meaning that revenues would continue to be used for any lawful Town program, improvement, or service. If approved, the tax under Measure C would become effective on April 1, 2017 and expire on March 31, 2027, unless extended by Fairfax voters at a subsequent election. All revenues raised by the TUT would remain in the Town and would not be shared with the State or any other agency. Measure C requires annual independent audits to verify that tax revenues are collected, managed and expended in accordance with its terms. By placing Measure C on the ballot, the Town complies with Article XIIIC of the California Constitution (Proposition 218), which requires a majority of the voters to approve an ordinance which establishes, extends or increases a general tax. A "yes" vote on Measure C will authorize a 10-year extension and a 1/4% rate increase to the current TUT. A "no" vote on Measure C will not authorize a 10-year extension and 1/4% rate increase to the current TUT and means the current TUT will expire on March 31, 2017.[2] |
