The vacancy warning level remains at yellow this week as there were no changes in the judiciary, keeping the vacancy percentage at 10.5%. There were no new nominations or confirmations this week, allowing the total number of nominees waiting for confirmation to remain at 50. There were no new vacancies this week, keeping the total number of vacancies of Article III judges at 91 out of 865. A breakdown of the vacancies on each level can be found in the table below. Court of Appeals for the Armed Forces

Kevin A. Ohlson
On October 16, 2013, Kevin A. Ohlson was confirmed by the U.S. Senate. Ohlson spent more than two years awaiting a confirmation from the Senate as he was nominated on September 14, 2011. Leading up to his confirmation Ohlson was the Chief of the Professional Misconduct Review Unit in the United States Department of Justice, a position in which he served from 2011 until his confirmation. Ohlson also served in the U.S. Army during the Persian Gulf War where he received a Bronze Star. His education includes a B.A. from Washington and Jefferson College and a J.D. from the University of Virginia School of Law.[1] His confirmation removes the only vacancy on the United States Court of Appeals for the Armed Forces. The vacancy level for this court has changed from yellow to green.
