Getting measures on the ballot
Citizens:
Florida allows citizens to initiate constitutional amendments. Sponsors must first register as a political committee with the Florida Division of Elections and submit the proposed initiative petition to the Division of Elections. If the petition format is approved by the Division of Elections, a serial number will be assigned and proponents may begin collecting signatures.
The total number of signatures required for an initiated constitutional amendment to qualify for the ballot is equal to 8% of the votes cast in the preceding presidential election. To qualify an initiative for the 2022 ballot, initiative proponents needed to collect 891,589 valid signatures. Florida also has a signature distribution requirement, which requires that signatures equaling at least 8% of the district-wide vote in the last presidential election be collected from at least half (14) of the state's 27 congressional districts. Signatures remain valid until February 1 of even-numbered years and must be verified by February 1 of the general election year the initiative aims to appear on the ballot.
Proposed measures are reviewed by the state attorney general and state supreme court after proponents collect 25% of the required signatures across the state in each of one-half of the state's congressional districts (222,898 signatures for 2022 ballot measures). After these preliminary signatures have been collected, the secretary of state must submit the proposal to the Florida Attorney General and the Financial Impact Estimating Conference (FIEC). The attorney general is required to petition the Florida Supreme Court for an advisory opinion on the measure's compliance with the single-subject rule, the appropriateness of the title and summary, and whether or not the measure "is facially invalid under the United States Constitution."[1]
Initiative signatures must be verified by February 1, 2022 and, thus, must be submitted to county officials long enough before that date to allow for the verification process. County supervisors of elections have a maximum of 30 days to verify signatures and submit them to the secretary of state, which means to guarantee that local officials verify and submit signatures, they should be submitted by January 2, 2022.
Legislature:
During the 2021 and 2022 state legislative sessions, the Florida Legislature could put constitutional amendments on the ballot through a 60% vote in both the Florida State Senate and the Florida House of Representatives.
