Ballot title
The ballot title for Compensation and Qualifications of Legislators Amendment was as follows:
| “ | To amend Section 4, of Article III, of the Constitution of the State of Florida, relating to pay of members of the Senate and House of Representatives and providing that Senators and members of the House of Representatives shall be duly qualified electors in the respective counties and districts for which they are chosen. The pay of members of the Senate and House of Representatives shall not exceed twelve dollars and fifty cents ($12.50) a day for each day of session; and mileage to and from their homes to the seat of government not to exceed ten cents (10¢) a mile each way by the nearest and most practicable route. | ” |

Constitutional changes

Section 4. Senators and members of the House of Representatives shall be duly qualified electors in the respective counties and districts for which they are chosen; The pay of members of the Senate and House of Representatives shall not exceed twelve dollars and fifty cents ($12.50) a day for each day of Session; and mileage to and from their homes to the Seat of Government not to exceed ten (10) cents a mile each way by the nearest and most practicable route. This Amendment shall go into effect at midnight on December 21, 1928, without the necessity of Legislation. |
Path to the ballot

A 60% vote was required during one legislative session for the Florida State Legislature to place a constitutional amendment on the ballot. That amounted to a minimum of 51 votes in the Florida House of Representatives and 18 votes in the Florida State Senate, assuming no vacancies. Amendments did not require the governor's signature to be referred to the ballot. Amendments on the ballot required a simple majority vote in this year.
