Former police chief to receive retrial for murder charges

South Dakota: A second trial has begun for former Highmore Police Chief Ken Huber charged with the murder of his wife. Huber, who was convicted in 2008 has been given a second chance to prove his innocence by the South Dakota Supreme Court after they threw out the first conviction on the grounds that he did receive a fair trial. The court found that Huber had not been allowed to present a witness to support his argument that the shooting was accidental and that, therefore, a retrial was in order. Huber maintains that Glock .40-caliber pistol fired accidentally on October 28, 2007, and the bullet struck his wife, Pam Huber, as she lay on a bed. Prosecutors responded to Huber's claims by saying that there is no reasonable chance the shooting was accidental.[1][2]
