Georgia Amendment 5 was on the ballot as a legislatively referred constitutional amendment in Georgia on November 5, 1968. It was approved.

A "yes" vote supported establishing that the Secretary of State, Attorney General, State School Superintendent, Comptroller General, Treasurer, Commissioner of Agriculture, and Commissioner of Labor are elected in the same manner as the Governor, and allow the Governor the authority to fill vacancies if an elected official dies or withdraws before taking office.

A "no" vote opposed establishing that the Secretary of State, Attorney General, State School Superintendent, Comptroller General, Treasurer, Commissioner of Agriculture, and Commissioner of Labor are elected in the same manner as the Governor, and allow the Governor the authority to fill vacancies if an elected official dies or withdraws before taking office.

Ballot title

The ballot title for Amendment 5 was as follows:

Shall the Constitution be amended so as to provide that the Secretary of State, Attorney General, State School Superintendent, Comptroller General, Treasurer Commissioner of Agriculture, and Commissioner of Labor shall be elected in the same manner as the Governor and the procedures relating to the election of the Governor shall apply to said officers and to provide that in the event of the death or withdrawal of any person elected to any such office prior to his taking office the Governor shall be authorized to fill such office?

A two-thirds (66.67%) vote is required during one legislative session for the Georgia State Legislature to place an amendment on the ballot. That amounts to a minimum of 120 votes in the Georgia House of Representatives and 38 votes in the Georgia State Senate, assuming no vacancies. Amendments do not require the governor's signature to be referred to the ballot.
