MADISON, Wisconsin: Dane County Judge Juan B. Colás ruled last Friday that Governor Scott Walker's collective bargaining law was in violation of the constitution.[1][2] Judge Colás wrote in his decision that sections of the law, "single out and encumber the rights of those employees who choose union membership and representation solely because of that association and therefore infringe upon the rights of free speech and association guaranteed by both the Wisconsin and United States Constitutions."[3]

Response to ruling

Positive response

This is a sound decision by the court that upholds what we were saying all along - that Act 10 violates constitutional rights.[3][1] - Christina Brey, spokeswoman for the Wisconsin Education Association Council

As we have said from day one, Scott Walker's attempt to silence the union men and women of Wisconsin's public sector was an immoral, unjust and illegal power grab.[3] - Phil Neuenfeldt, president of the Wisconsin State AFL-CIO.

This decision will help re-establish the balance between employees and their employers.[3] - Rep. Peter Barca[4]

Wisconsin

Negative response

The people of Wisconsin clearly spoke on June 5th. Now, they are ready to move on. Sadly a liberal activist judge in Dane County wants to go backwards and take away the law making responsibilities of the legislature and the governor. We are confident that the state will ultimately prevail in the appeals process.[3] - Governor Walker[2]

I'm confident it's a single judge out of step with the mainstream and we'll continue to implement it.[3] - Rep. Robin Vos[4]

The Wisconsin Department of Justice spokeswoman Dana Brueck also said they believe the law to be constitutional.[3]

The Walker administration plans to appeal the decision.[3]
