Noteworthy cases
Order granting temporary restraining order barring enforcement of Alaska’s opt-in membership protocol for public-sector unions (2019)
On October 4, 2019, Miller issued a temporary restraining order barring enforcement of an opt-in membership protocol for Alaska’s public-sector unions representing state workers. The protocol had been announced via administrative order on September 26, 2019. The Alaska State Employees Association had requested the restraining order.[4]
In response to this development, Jake Metcalfe, president of the Alaska State Employees Association, said, “Our position is the right position. The governor was trying to take rights away from his own employees and that’s never a good thing.”[4]
Assistant Attorney General Cori Mills said, “We are disappointed with the ruling, though we will, of course, abide by the court’s order. The Attorney General continues to stand behind his opinion, and the state will continue to pursue the case to get final resolution on this important constitutional question.”[4]
