Shaftsbury, Vermont: The Vermont Environmental Court is currently considering an appeal involving a zoning matter and a local gun club known as the Hale Mountain Rod & Gun Club. However, a request by the Select Board has been made to bring the matter and dispute before the Shaftsbury Development Review Board.[1]
The dispute has been officially going on since 2004 between the Hale Mountain Rod & Gun Club and the neighbors next door, Owen and Kathy Beauchesne. The neighbors have argued that the gun club has blatantly failed to heed local, as well as state building permits that have been required for the expansions the gun club has done over the years.[1]
Select Board members have made aware their displeasures, as well as board member Craig Bruder who said he found it "disturbing that the gun club has wantonly and blatantly stepped around the zoning bylaws in place."[1]
The issue has gone before the Vermont Environmental Court many times, and has even gone before the Vermont Supreme Court.[1]
The Hale Mountain Rod & Gun Club and the Beauchesnes have gone back and forth appealing the decisions made by the courts, and a decision made on August 23rd, 2011 had given the Beauchesnes until September 23rd, 2011 to provide the needed evidence that they have been impacted by the work done at the gun club's shooting range.[1]
As of now, it has still to be heard what the court will decide based on the evidence the Beauchesnes provided.
