The Hawaii Regarding Bail, Amendment 5, also known as Amendment 5, was on the ballot in Hawaii on November 5, 1968, as a convention referred constitutional amendment. It was approved. The amendment proposed one addition to the constitution: Article I, Section 9. The amendment would permit courts to dispense with bail if they are reasonably satisfied that the defendant or witness would appear when directed, except for a defendant charged with an offense punishable by life imprisonment.[1]
