The Idaho Marijuana Legalization Initiative was not on the ballot in Idaho as an initiated state statute on November 8, 2022.

The initiative would have legalized the possession, use, and transfer of up to three ounces of marijuana by adults 21 years of age or older.[1][2]

Sponsors

The Idaho Way led the campaign in support of the initiative.[3]

Ballot titles

The short ballot title would have been as follows:[2]

Initiative legalizing possession, use, and transfer of up to three ounces of marijuana by persons at least twenty-one years old.[4]

The long ballot title would have been as follows:[2]

An initiative relating to marijuana; amending Title 37, Idaho Code, by addition of a new Chapter 35, known as the "Personal Adult Marijuana Decriminalization Act" to decriminalize the possession, use, and transfer of up to three ounces of marijuana by persons at least twenty-one years of age; establishes conduct limitations that are not protected from civil or criminal penalties and sanctions; establishes facility restrictions that provide facilities such as nursing homes, intermediate care facilities, hospice houses, hospital, or other residential care or assisted living facilities with the authority to adopt reasonable restrictions on the personal use of marijuana; establishes protections for the personal use of marijuana; provides that discrimination is prohibited against persons that use marijuana as authorized by this act; provides for severability; amends Title 37, Chapter 27, Idaho Code, known as the Idaho Controlled Substances Act, to incorporate the new Title 37, Chapter 35; and amends Title 36, Chapter 42, Idaho Code, known as the Illegal Drug Stamp Tax Act, to change the illegal quantity of marijuana to more than three (3) ounces.[4]

The state process

In Idaho, the number of signatures required to qualify an initiated state statute for the ballot is equal to 6 percent of the registered voters as of the state's last general election. Petitions can be circulated for up to 18 months. Idaho features a distribution requirement that signatures equal to at least 6 percent of registered voters in 18 of the state's 35 legislative districts be included in petitions. Signatures for initiatives must be submitted by May 1 of the year in which the measure is to go on the ballot.

Initiative petition signatures are verified by county clerks and then sent to the secretary of state for certification.
