Forty-two Idaho county magistrates were up for retention elections on November 8, 2016. While both district judges and magistrates are elected in Idaho, no district judge seats were up for election in 2016. Those seats were up for election in 2020.

HIGHLIGHTS
  • Half of Idaho's counties had one or more magistrates up for retention election in 2016.
  • The other 22 counties did not have magistrates facing retention election in 2016. Those counties were the following: Bear Lake, Benewah, Boise, Bonner, Boundary, Cassia, Clearwater, Custer, Fremont, Gooding, Idaho, Jefferson, Latah, Lewis, Lincoln, Madison, Minidoka, Oneida, Owyhee, Power, Shoshone, and Valley.
  • The filing deadline for magistrates wishing to seek retention was September 1, 2016.[1][2][3][4][5][6][7][8][9][10][11][12][13][14][15][16][17][18][19][20][21][22][23]

    • Every county in Idaho is part of one of the state's seven judicial districts. Each district is served by a district court, and each county has a magistrate division within the district. Magistrates hear misdemeanors, municipal infractions (such as traffic tickets), and civil cases where the amount involved is less than $10,000.[24]

    Magistrates may hold preliminary hearings and issue warrants. They can handle probate, juvenile, and domestic relation cases, as well as habeas corpus proceedings. Magistrates may also hear small claims cases informally and without attorneys, in what is known as the "people's court."[24]

    Election rules

    Primary election

    District court races are decided during the state's primary election. However, if no candidate in a judicial race receives over 50 percent of the votes in the primary, the two candidates who received the greatest number of votes advance to the general election, which functions as a sort of judicial runoff election.[25]

    If a race advances to the general election, but one of the candidates leaves the race before that time, the candidate who received the next highest number of votes in the primary takes their spot on the general election ballot. In such a situation, if there is a tie for third place in the primary, the candidate to advance to the general election is chosen by lot by the secretary of state.[26]

    Retention election

    Magistrates stand for retention in the general election, which is held in November. Judges file for retention in August. Specifically, they must file their declaration of candidacy no less than 90 days prior to the election.

    The ballot includes the following language for such elections: "Shall Magistrate __ of __ County of the __ Judicial District be retained in office?" The voter may then choose to answer either "Yes" or "No". The magistrate must receive a majority of "yes" votes to be retained to a new term.[27]
