Idaho man will appeal marijuana case to state's high court

BOISE, Idaho: The Idaho Court of Appeals denied an Idaho man's appeal related to his 2007 conviction for marijuana possession. Cary William White was convicted of marijuana possession in 2007 when an officer discovered marijuana in White's car during a traffic stop.[1] White argues that he uses marijuana in a religious manner, and that his use of the drug is protected under Idaho's Free Exercise of Religion Act. He says he began using the drug as a natural pain reliever following an accident, and that he found marijuana to have spiritual properties.[2] The Idaho Court of Appeals ruled that White's use of the drug was not substantially motivated by religious belief. White plans to appeal to the Idaho Supreme Court.
