To fund and improve County services, shall the ordinance enacting the following general taxes on cannabis be adopted? (1) Maximum 8% on the gross receipts of retailers of cannabis products; (2) Maximum 5% on the gross receipts of manufacturers of cannabis products; (3) Maximum $15.00 per square foot on commercial cannabis cultivation space, increasing to maximum $20.00 per square foot on July 1, 2020 and maximum $25.00 per square foot on July 1, 2025.[2] |

The following impartial analysis of the measure was prepared by the office of the Imperial County Counsel:

On November 8, 2016, voters passed Proposition 64, which legalized the cultivation, manufacture, distribution, testing, sale, and delivery of cannabis and cannabis products within the State of California. The County of Imperial (“County”) by ordinance proposes a general tax for general governmental purposes on persons engaged in specified commercial cannabis activities, to be levied at the following maximum rates: 8% on gross receipts of cannabis retail sale; 5% on gross receipts of cannabis manufacture; and $15 per square foot on the space utilized for cannabis commercial cultivation, increasing to $20 per square foot beginning July 1, 2020 and $25 per square foot beginning July 1, 2022. State law authorizes the County to levy a general tax if the ordinance proposing the tax is approved by the Board of Supervisors, and the tax is approved by a majority of the qualified voters of the entire County voting in the election. The Board of Supervisors unanimously approved the tax on February 27, 2018. If a majority of the voters in the County who vote on this measure vote “Yes,” the measure will pass and the general commercial cannabis activity tax will be levied commencing June 5, 2018. The Board of Supervisors placed the measure on the ballot. Any revenue generated by the tax will be deposited into the General Fund. The Board of Supervisors will annually appropriate the revenue from the tax for general governmental purposes. This measure does not restrict the use of the tax revenue to any specific purpose. If approved, the tax shall take effect and be in force immediately upon its adoption by a majority of voters at the June 5, 2018 election. The tax will continue until repealed by the Board of Supervisors or County voters. A “yes” vote is a vote to authorize the levy of a general commercial cannabis activity tax at the maximum rates of 8% (sales), 5% (manufacture), and $15 per square foot (cultivation) for specified commercial cannabis activities. A “no” vote is a vote not to authorize the levy of the general commercial cannabis activity tax.[2] |
