Wiener was first nominated by President George H.W. Bush on June 27, 1988, to a seat vacated by Judge Robert Madden Hill. On October 22, 1988, Wiener's nomination was returned to the president at the sine die adjournment on the U.S. Senate. President Bush resubmitted Wiener's nomination on November 17, 1989. The American Bar Association rated Wiener Unanimously Well Qualified for the nomination.[2] Hearings on Wiener's nomination were held before the United States Senate Committee on the Judiciary on February 21, 1990, and his nomination was reported by then-U.S. Sen. Joseph Biden (D-Del.) on March 8, 1990. Wiener was confirmed by the unanimous consent of the U.S. Senate on March 9, 1990, and he received his commission on March 12, 1990. Wiener assumed senior status on September 30, 2010.[1][3][4] He was succeeded in this position by Judge Stephen Higginson.
