Jane Marum Roush
Jane Marum Roush was a justice of the Supreme Court of Virginia. She was appointed by Governor Terry McAuliffe (D) on July 27, 2015, to replace Justice Leroy Millette. She took office on August 1.[1]
Appointment controversy
McAuliffe appointed Roush on an interim basis when the legislature was not in session. Recess appointments like Roush's expire 30 days after the legislature reconvenes unless legislators elect the appointee to a full term. Because legislators declined to affirm Roush's appointment during an August 17 special session, her tenure on the court was set to expire on September 16. McAuliffe announced plans to temporarily reappoint Roush, but his authority to do so was in question because of uncertainty over whether the special session was properly adjourned. The governor cannot make a recess appointment when the legislature is in session. The Supreme Court of Virginia amended its calendar to end its September session on September 16.[2][3]
On Tuesday, September 15, McAuliffe said he would give Roush another interim appointment the next day, asserting the power to do so because he concluded that the General Assembly was not in session. Her appointment would last until 30 days after the General Assembly's next session.[4]
In December 2015, House Republicans signaled that they would remove Roush from the bench. They did not invite her to judicial interviews taking place in mid-December, effectively blocking the possibility of the House voting to confirm her appointment during the 2016 legislative session. Speaker William J. Howell said she invalidated her position on the bench when she accepted Governor McAuliffe's temporary reappointment despite Republicans initially denying her a seat on the Supreme Court. Howell called that move unconstitutional.[5]
The General Assembly ultimately selected Stephen R. McCullough to permanently replace Millette on the court.
