Lugo was charged with simple assault and disorderly conduct after allegedly attacking Jennifer Rourke (D) at an abortion rights protest in Providence, Rhode Island. Lugo responded on Twitter that he "will not be running for any office this fall," and told CNBC, "At this moment, there’s a pending internal investigation, and as the facts of the incident come to light, I request that my family and I have privacy."[1]

Lugo pleaded not guilty on July 8, 2022.[2] He was acquitted of the charge on November 16, 2022.[3]
