Joseph H. McKinley, Jr. is a federal judge on senior status for the United States District Court for the Western District of Kentucky. He joined the court in 1995 after being nominated by President Bill Clinton. He assumed senior status on June 9, 2019. McKinley was the chief judge of the court from 2011 to 2018.

Early life and education

Born in Owensboro, Kentucky, McKinley graduated from the University of Kentucky in Lexington in 1976 and from the University of Louisville Law School with his Juris Doctor degree in 1979.[1]

Professional career

McKinley was a private practice attorney in Owensboro, KY from 1979 to 1991. McKinley also served as a commissioner for the Kentucky Oil and Gas Conservation Commission from 1982 to 1990. McKinley was a part-time assistant county attorney for Daviess County from 1985 to 1987 and later served as a hearing officer for the Kentucky Natural Resources and Environmental Protection Cabinet from 1990 to 1991. In 1992, McKinley was elected judge for the Daviess County Circuit Court until 1995.[1]

Judicial Career

Western District of Kentucky

On the recommendation of Senator Wendell Ford, McKinley was nominated to the United States District Court for the Western District of Kentucky by President Bill Clinton on May 24, 1995, to a seat vacated by Ronald Meredith. McKinley was confirmed by the Senate on August 11, 1995, on a Senate vote. He received commission on August 14, 1995. He assumed senior status on June 9, 2019. McKinley was the chief judge of the court from 2011 to 2018.[2][1]

Federal tobacco case (2009)

Judge McKinley presided in the case involving federal tobacco marketing laws. Major tobacco companies, including Philip Morris and RJ Reynolds, sued the Food and Drug Administration on new regulations of tobacco products in terms of marketing of the products. The judge found no evidence that the FDA violated First Amendment rights through increased marketing regulation.[3]
