Joe Rathert is a municipal court judge for the municipality of Jefferson County in Jefferson County, Missouri. He joined the court in December of 2010.[1][2][3]

Rathert is a former candidate for the 23rd Judicial Circuit Court in Missouri.[4] He was defeated in the general election on November 8, 2016.

Education

In 1985, Rathert attended St. Louis University for his B.S. and in 1988, he attended Capital University for his J.D.[3][5]

Missouri held general elections for local judicial offices on November 8, 2016. A primary election took place on August 2, 2016. The filing deadline for those wishing to run in the primary was March 29, 2016. Judges running in a retention election on November 8 had to file by August 23.[6] Carl Yates defeated Joseph Rathert in the Missouri 23rd Circuit (Division 1) special election.[4]

Rathert ran for election to the 23rd Judicial Circuit Court.
Primary: He was successful in the Democratic primary on August 5, 2014, receiving 57 percent of the vote. He competed against John S. Appelbaum.
General: He was defeated in the general election on November 4, 2014, after receiving 45.3 percent of the vote. He competed against Jeffrey Coleman. (Write-in votes = .14%)[7][8]

Rathert lost the Democratic primary for Division 14 of the 23rd Judicial Circuit Court to Timothy Miller.[9]

Selection method

The 141 judges of the Missouri Circuit Courts are elected to six-year terms in partisan elections, except in the cities of Springfield, St. Louis, and Kansas City. At the end of their terms, judges must face re-election.[10]

The chief judge of each court is elected by the circuit and associate judges from among the sitting circuit judges.[10]

Qualifications
To serve on this court, a judge must be:

  • a U.S. citizen for at least 10 years;
  • a qualified state voter for at least three years;
  • a resident of the circuit for at least one year;
  • licensed to practice law in the state; and
  • at least 30 years old.[10]
