Judge Carey rejects motion to acquit in Waterman Case
February 7, 2011
Alaska: Judge William Carey has denied the defenses motion to acquit Rachelle Waterman based on possible misconduct by the state.
Last week a former state trooper, Anna Goemer, said that Sgt. Mark Habib, one of the investigators on the Waterman case, told her he lied under oath during the first trial in an attempt to get a conviction.
The prosecution has admitted they should have turned over e-mails about the possible misconduct by the investigator, but they say Waterman didn't suffer because the witness brought it to the defense.[1]
