Judge makes mistake in sentencing drug dealer

North Dakota: The 8th U.S. Circuit of Appeals said that District Judge Ralph Erickson made a mistake in the sentencing of a drug dealer in 2010.

In August 2010, Judge Erickson sentenced Darrin Raysor, who was charged with dealing cocaine, to 52 months in prison. The minimal sentencing for a drug dealer is a mandatory 60 months in prison. The appeals court said that Erickson did not have the authority to reduce the sentence below its minimum and the case was ordered to the district court for re-sentencing.[1]
