The Kansas Insurance Commissioner is an elected state executive position in the Kansas state government. The commissioner serves as the head of the Kansas Department of Insurance, which regulates and reviews companies for financial solvency and regulatory compliance, educates consumers and helps license agents selling insurance products in the state.[1]

Authority

The Kansas Commissioner of Insurance's powers, term of office, etc. are derived from Chapter 4, Article 1 of the Kansas Code.

Article 1, Section 2:

There is hereby established a department to be known as the insurance department, which shall have a chief officer entitled the commissioner of insurance...[2]

Qualifications

The commissioner's qualifications are established by statute.

According to Chapter 40, Article 1, Section 9, the commissioner of insurance must be:[3]

  • An elector of the state of Kansas
  • Experienced in the field of insurance
  • Unaffiliated in any personal and/or professional capacity with insurance companies have "any financial interest in any insurance company other than as a policyholder"

Elections

As with Kansas' other executive officers, the insurance commissioner is elected to serve for a term of four years of length, which runs concurrently with the term of the governor. The election is held in November and the statewide official takes office the following January.[4]

Vacancies

Under Chapter 40, Article 1, Section 6 of the Kansas Statutes: "In case of a vacancy in such office the governor shall appoint some suitable person to serve for the unexpired term and until a successor is elected and qualified."[5]

Duties

The commissioner's duties are introduced in Chapter 40, Article 1, Section 2 of the Kansas Statutes. Within this section, the officer entitled commissioner of insurance "is charged with the administration of all laws relating to insurance, insurance companies and fraternal benefit societies doing business in this state, and all other duties which are or may be imposed upon such officer by law." Section 3 of the Article 1 elaborates on the commissioner's duties, giving the commissioner "general supervision, control and regulation of corporations, companies, associations, societies, exchanges, partnerships, or persons authorized to transact the business of insurance, indemnity or suretyship in this state and shall have the power to make all reasonable rules and regulations necessary to enforce the laws of this state relating thereto."[6]
