Gov. Gavin Newsom (D) appointed Smith to the court on July 9, 2021, to replace Keith Davis. Although California Superior Court judges are elected in nonpartisan elections, a press release from Gov. Newsom's office announcing Smith's appointment identified him as a Democrat.[1]
