Murder conviction thrown out eight years later
The Missouri Court of Appeals, Western District, overturned the robbery and murder convictions of Ryan Ferguson on November 5, 2013. Ferguson and Charles Erickson were accused of the 2001 murder of Kent Heitholt, a sports editor for the Columbia Tribune. Erickson made a deal with law enforcement to implicate Ferguson, who was sentenced to 40 years in prison in 2005. Erickson later recanted his testimony that Ferguson was present at the murder scene. Ferguson maintained his innocence.[5]
Crane was the prosecutor in Ferguson's murder case. The appeals court found that Crane's office violated the law in failing to share several pieces of evidence with the defense counsel. The court stated, "We conclude that Ferguson did not receive a fair trial. His verdict is not worthy of confidence."[6] After the state Attorney General's office announced that it would not pursue a retrial, Ferguson was freed on November 12, 2013.[6]
