Judge rules rape victim should carry pregnancy to term, but no guardian appointed for the fetus
Controversy arose around the pregnancy of a mentally retarded woman who was raped. The woman, referred to as "J.D.S." to preserve her privacy, was 22, but had much younger mental abilities. The Governor at the time, Jeb Bush, said that he believed a court-appointed guardian should be named for the woman's fetus. Judge Kirkwood, however, rejected the request, explaining, "There is no basis in the statutes or case law for appointment of a guardian for a fetus."[3]
Judge Kirkwood did rule that the baby should be carried to term, following the suggestion of Patti Jarrell, the court-appointed guardian of J.D.S. Doctors reported that birthing the baby would pose no medical problems for the mother.[4]
