The Louisiana Post-Conviction Bail Amendment was not on the ballot in Louisiana as a legislatively referred constitutional amendment on November 8, 2022.[1]

The amendment would have amended the state constitution to provide that the state legislature may provide in state law for post-conviction bail. As of 2022, setting bail was up to the sole discretion of judges.[1]

Do you support an amendment to provide that post-conviction bail shall not be solely in the discretion of the judge but shall be allowed only in accordance with bail provisions as provided by the Legislature of Louisiana and that bail for crimes of violence and drug offenses where the proof is evident and the presumption of guilt is great shall not be solely in the discretion of the judge but shall be allowed only in accordance with bail provisions as provided by the Legislature of Louisiana? In Louisiana, a two-thirds vote is needed in each chamber of the Louisiana State Legislature to refer a legislatively referred constitutional amendment to the ballot for voter consideration.

This amendment was introduced as Senate Bill 4 on January 26, 2022. On May 17, 2022, the state Senate passed SB 4 by party lines in a vote of 27-11, with Republicans voting in favor and Democrats voting against. The measure was not passed before the legislature adjourned the 2022 legislative session on June 6, 2022.[1]
