Recall reports

An effort to recall Malin Parker in Roosevelt County, New Mexico, from his position as sheriff was launched in July 2017. The reasoning for the effort, according to the recall petition, was that "Malin Parker has a policy, custom and routine of retaliating against any individual(s) ... who oppose him and his policies." Roosevelt County Attorney Randy Knudson, who represented Malin, said the accusations were frivolous.[1] The recall petition was dismissed by District Judge Fred Van Soelen, who said that the recall seemed to be "either a harassment measure or a personal vendetta."[2]

Recall supporters

The recall petition was initiated by Cody Banister and Armando Pena, who were criminal defendants, and the mother of a woman who died in a car chase involving the police. They were represented in court by attorney Eric Dixon. Banister and Pena claimed they had been victimized by Parker.[3]

Recall opponents

Roosevelt County Attorney Randy Knudson argued that the petition was composed of "frivolous claims, none of which demonstrate any misfeasance or malfeasance on the part of the sheriff."[3]

Van Soelen granted the motion to dismiss the recall petition.[2]

If the recall had gone forward, recall proponents would have needed to collect 1,288 valid signatures, which was 33.3 percent of the number of people who voted in the county's last election for sheriff.[3]
