On July 23, 2018, Nicholson was arrested for driving while intoxicated and failure to control a motor vehicle. Because it was her first offense, Nicholson was given a citation rather than charged with a criminal offense. A breath test administered by police showed Nicholson had a blood-alcohol content of 0.18. In a statement, Nicholson said, "I made a horrible mistake, and I am embarrassed by my actions. I apologize to my constituents, colleagues and community members for my inexcusable decision."[1]
