An effort to recall Newton County Board of Commissioners Chairman Marcello Banes in Georgia was initiated in 2023. Recall supporters had until November 29, 2023, to collect the required 23,698 signatures to get the recall on the ballot.[1] On September 27, the recall petition was declared legally insufficient by the Newton County Board of Elections due to paperwork errors related to the required signature affidavit.[2]

Recall supporters listed "allegations related to Banes’ personal businesses doing business with the county," allegations of the "misuse of county funds," and the "strained working relationship between Banes and District 3 Commissioner Alana Sanders" as grounds for recall.[1]

In a statement, Banes responded to the recall petition by arguing that it was based on misinformation.[2]

Georgia allows the following grounds for recall: conducted himself or herself in a manner that adversely affects the administration of his or her office and adversely affects the rights and interests of the public; malfeasance while in office; violated his or her oath of office; misconduct; failure to perform duties prescribed by law; and willfully misused, converted, or misappropriated, without authority, public property or public funds entrusted to or associated with the elective office to which the official has been elected or appointed.[3] To get the recall on the ballot, supporters must collect signatures equal to 30% of the number of electors who were registered and qualified to vote in the preceding election for that office. Signatures must be collected within 90 days.[4][5]
