An effort to recall Mary Andersen from her position as a county commissioner in Valencia County was launched in November 2011.[1] The recall effort was thrown out by a judge in February 2012.[2]
Reasons for recall
Brian Benoit of Los Lunas filed the recall petition. The petition accused Andersen of abuse of power, conspiracy and ethical violations, among other charges. Benoit said Andersen "acted outside of the course and scope of her duties" when she voted to terminate a hospital contract with Valencia Health Commons.
Path to the ballot
The recall petition was filed on November 16th. Andersen had 30 days to respond to the allegations against her. Recall organizers and Andersen appeared before a judge in February 2012 to determine if there was probable cause for a recall election. The judge found that there was no probable cause for a recall.[2] If probable cause had been established, recall organizers would have needed to collect the signatures of 1,782 registered voters.[1] If Andersen had been removed from office, the Governor of New Mexico would have filled the vacancy on the county commission.
