Noteworthy cases
Fix Wilson Yard vs. City of Chicago and Wilson Yard Development
Five developers invested in building a commercial and residential district at Wilson Yard in Chicago's Uptown neighborhood. After four of the commercial investors abandoned the project, citizens created the nonprofit organization, Fix Wilson Yard, to stop the building of primarily low-income housing. The group attempted to obtain a temporary restraining order against the developers, which was denied by Judge Rochford and was “heavily based on the significant financial harm to the developer.”[6] Attempting a different angle, Fix Wilson Yard sued the City of Chicago based on the misuse of tax increment financing for capital developments. Judge Rochford dismissed the contentious lawsuit in May 2009, claiming that the plaintiffs had exceeded the five-year statute of limitations for filing.[6]
