The Maryland Succession of the Governor Amendment, also known as Amendment 5, was on the November 5, 1940 ballot in Maryland as a legislatively referred constitutional amendment, where it was defeated. The measure would have prohibited the governor from succeeding himself for a term directly following the one for which he was elected.[1][2]
